CABINET FORWARD PLAN

 

What is the Cabinet Forward Plan?

 

The Cabinet Forward Plan is a list of all non-key and key decisions the Authority intends to take during the next four month period.  The Plan is updated monthly on or around the 14th of each month and is available to view on-line at www.york.gov.uk

 

What is a non-key decision?

 

For the purposes of the Plan, a non-key decision is defined as a ‘decision of normal importance’ which:

 

·                 the Cabinet can collectively take as set out in Part 3 of the council’s constitution

 

·                 which any Cabinet Member can take individually in line with the Council’s Scheme of Delegation

 

What is a key decision?

 

A key decision is defined as a decision which is likely:

 

·                 to result in the Council incurring expenditure, or making savings, which are significant having regard to the Council’s budget for the service or function to which the decision relates i.e.:

 

           make a saving of more than 10% of the budget for a particular area  - or be more than £500,000

           require spending that is more than 10% of the budget for a particular area - or be more than £500,00

 

·                 to be significant in terms of its effects on communities

 

In addition to elected Councillors, chief officers can also take key decisions in line with the Officers Delegation Scheme as set out in Schedule 3, Part 3 of the Council’s Constitution

 

 

 

What information does the Forward Plan contain?

 

Each issue entered in the Forward Plan lists:

 

·                 The history of the issue in relation to the Forward Plan

·                 What consultation will be undertaken prior to a decision being made

·                 The name and contact details of the chief officer responsible for the issue and the forthcoming report

·                 The date of the meeting at which a decision is due to be taken

·                 The wards which will be affected by any decision taken

Minerals and Waste Planning

Description:

 

Purpose of Report: To provide an update on recent developments concerning the future review of the Joint Minerals and Waste Plan (JMWP) and the implications for the emerging York Local Plan.

The Executive Member will be asked to:

 

i.      Note the change in circumstances relating to the future review of the Joint Minerals and Waste Plan.

ii.    Note that City of York Council remains the Minerals and Waste Planning Authority for York and must ensure that its statutory planning responsibilities continue to be addressed through the plan-making process.

iii.   Endorse the inclusion of minerals and waste planning matters within the scope of the emerging York Local Plan and the forthcoming scoping consultation in order to ensure that all reasonable options remain available to the Council and that statutory plan-making requirements can be met, acknowledging there is a delay to the Plan-Making Activity Schedule previously agreed by Executive.

iv.   Note that, exercising delegated powers arising from the April 2026 Executive decision to commence preparation of a new Local Plan, the Director of City Development will amend and reissue the Formal Notice of Plan-Making to reflect the inclusion of minerals and waste planning matters within the scope of the emerging Local Plan.

v.    Request that officers prepare a further report for Executive in October 2026 setting out:

·         The strategic implications of the changing position across York and North Yorkshire;

·         The options considered for future minerals and waste plan-making;

·         The programme, governance, staffing and financial implications of those options;

·         a revised Plan-Making Activity Schedule inclusive of the Local Plan Timetable;

·         An update on the Council's approach.

 

The Council aims to give the same 28 days clear notice of non-key decisions as it does for key decisions, for this item, this has not been possible in order to allow progress of the Local Plan preparation to continue, avoiding undue delay to the agreed timetable.

Preparation for Potential Use of Compulsory Purchase Powers at Willow House to Support the Delivery of Affordable Housing

Description:

 

Purpose of Report:
To prepare for the potential use of compulsory purchase powers under Section 17 of the Housing Act 1985 to support land assembly for the Willow House development. The scheme will redevelop the former Willow House care home, associated garages and storage units on Council-owned land into 36 high-quality affordable homes with new play and amenity space. Full planning permission for the scheme was granted on 7 May 2026.

To deliver the approved layout, five leasehold stores and one leasehold garage must be acquired by the Council in the comparatively smaller, northernmost section where 10 of the 36 total new homes would be delivered. Negotiations have progressed, but not all interests are yet secured. A Compulsory Purchase Order (CPO) may be required as a last resort to ensure the scheme can proceed without delay.

The Executive will be asked to provide an in-principle decision in order to prepare for the potential use of compulsory purchase powers to support land assembly for the Willow House development.
